Version 2.4 — 14 October 2026. This agreement forms part of the terms of the OKStatus service (okstatus.eu) and applies to every Customer who uses OKStatus to monitor services that process personal data of their own users. A signed version can be requested at contact@clearcloud.fr.

DPA — Data Processing Agreement

Este documento aún no está disponible en tu idioma: estás leyendo la versión inglesa. ClearCloud es una empresa francesa y estas condiciones se rigen por la ley francesa: en caso de discrepancia, prevalece la versión francesa.

1. Parties and roles

  • Controller: the Customer (the organisation using OKStatus).
  • Processor: ClearCloud (SIRET 53993273100034, Dijon, France), operator of OKStatus.

The description of the processing is set out in Annex I.

2. Processor obligations (GDPR art. 28.3)

  1. Instructions. ClearCloud processes the data only on documented instructions from the Customer — use of the service and its configuration by the Customer constitute those instructions — and informs the Customer if an instruction appears to infringe the GDPR.
  2. Confidentiality of personnel. Persons authorised to process the data are bound by a contractual duty of confidentiality and access the data only where operationally necessary (support, incident), in a traceable way.
  3. Security. ClearCloud implements the technical and organisational measures set out in Annex II.
  4. Sub-processors. The Customer authorises the sub-processors listed in Annex III. Any addition or replacement is notified in writing (email to the organisation owner) with 30 days' notice; the Customer may object on legitimate grounds within that period. Failing a solution, the Customer may terminate the subscription without penalty, with amounts already paid for the unused period refunded pro rata. ClearCloud contractually imposes on every sub-processor obligations equivalent to this agreement and remains fully liable to the Customer for their performance.
  5. Assistance — data subject rights. ClearCloud helps the Customer respond to requests to exercise rights (access, rectification, erasure, portability, objection, restriction): export and deletion are available self-service; any other request is handled within 10 working days at contact@clearcloud.fr.
  6. Assistance — articles 32 to 36. ClearCloud assists the Customer, taking into account the nature of the processing and the information available to it, with the security of processing, notification of breaches to the supervisory authority and to data subjects, data protection impact assessments (DPIA) and prior consultation.
  7. Personal data breach. ClearCloud notifies the Customer without undue delay and at the latest 48 hours after becoming aware of it, at the organisation owner's address, stating: the nature of the breach, the categories and approximate number of data subjects and records concerned, the likely consequences, the measures taken or proposed, and a point of contact. Information not yet available is provided in phases.
  8. End of processing. At the Customer's choice, ClearCloud deletes or returns (JSON/CSV export) all personal data within 30 days of the end of the subscription, and confirms the deletion in writing on request; backups containing the data expire at the latest 30 days afterwards. Data whose retention is required by law (billing, 10 years) is excepted.
  9. Demonstrating compliance and audits. ClearCloud makes available the information needed to demonstrate compliance with article 28: this agreement and its annexes, the security policy, answers to standard questionnaires (CAIQ Lite / SIG Lite), the executive summary of the latest external security audit when one exists and, where applicable, the certifications obtained. An on-site audit, or one by a mandated third party, is possible once per 12-month period (more often after a confirmed breach), with 30 days' written notice, during working hours, at the Customer's expense, subject to a confidentiality agreement and without access to other customers' data.
  10. Records. ClearCloud maintains the record of categories of processing activities carried out on behalf of its customers (art. 30.2) and makes it available to the supervisory authority and to the Customer on request.

3. Customer obligations

The Customer warrants that it has a legal basis for the data it entrusts to OKStatus (in particular the authentication credentials it enters, the email addresses of alert recipients and of subscribers to its status pages), informs the data subjects, and configures no monitor against systems it is not authorised to test.

4. Duration, governing law

This agreement applies for the whole duration of the subscription and until the data is effectively deleted. It is governed by French law and by Regulation (EU) 2016/679. In the event of a conflict with the terms of service, this agreement prevails as regards personal data.
