Terms of service
Este documento ainda não está disponível no seu idioma: está a ler a versão inglesa. A ClearCloud é uma empresa francesa e estas condições regem-se pela lei francesa: em caso de divergência, prevalece a versão francesa.
- You keep full ownership of your data (art. 7.1).
- Paid plans: 99.9% monthly availability, with credits if we miss it (art. 6.1).
- Cancel anytime; it takes effect at the end of the billing period (art. 5.4).
- If we ever shut down: 90 days' notice and a full data export (art. 9.3).
Article 1 — Purpose and acceptance
These Terms of Service ("Terms") govern access to and use of the OKStatus service, available at okstatus.eu, provided by ClearCloud, SIRET 53993273100034, 21000 Dijon, France (hereinafter "OKStatus").
By creating an account or using the service, you accept these Terms in full. If you do not accept them, you must not use the service.
Article 2 — Description of the service
OKStatus is an uptime monitoring platform that lets users:
- Monitor the availability of their websites, APIs and services from several European regions
- Receive alerts on downtime or degradation
- Publish public status pages for their own users
- Generate monthly availability reports in PDF format
The service is offered in four plans: Free (no charge), Pro (€9/month), Max (€39/month) and Enterprise (from €99/month, on quotation).
Article 3 — Registration and account
3.1 To access the service you must create an account by providing a valid email address, or by signing in with Google or GitHub.
3.2 You are responsible for keeping your credentials confidential and for every action taken from your account.
3.3 You undertake to provide accurate information and to keep it up to date.
3.4 OKStatus reserves the right to suspend or delete any account in the event of a breach of these Terms.
Article 4 — Acceptable use
You undertake to:
- Use the service only to monitor domains, IP addresses and services that you own or for which you hold explicit authorisation
- Refrain from using the service to scan or test third-party systems without authorisation
- Refrain from attempting to circumvent the limits of your subscribed plan
- Refrain from using the service for unlawful or fraudulent purposes
The following are strictly prohibited:
- Using OKStatus to generate artificial traffic or DDoS-type attacks
- Reselling or sublicensing access to the service without prior authorisation
- Attempting to access other users' data
- Introducing viruses, malware or any malicious code
Article 5 — Billing and payment
5.1 Paid plans (Pro and Max) are billed monthly, in advance, through Stripe.
5.2 Displayed prices are in euros. No VAT is charged.
5.3 If a payment fails, OKStatus will notify you by email. After three unsuccessful attempts, your account will be downgraded to the Free plan.
5.4 You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — no pro-rata refund is made.
5.5 OKStatus reserves the right to change its prices with 30 days' notice by email.
5.6 Additional seats. On Pro and Max, you can add seats beyond those included in your plan, at 9 € per seat per month (97.20 € per year on annual billing). Seats are added to your subscription and follow its billing period. An addition is charged pro rata for the current period; for a removal, the unused part is credited on the next invoice. The number of seats cannot go below the current members and pending invitations. Additional seats end with the subscription.
5.7 SMS credits. SMS alerts use prepaid credits. The Max and Enterprise plans include a number of credits each calendar month (50 and 200), which do not carry over to the next month and are used before purchased credits. Packs of 100 or 500 credits are bought individually, by immediate payment, from the Pro plan; they are valid 12 months from purchase. An SMS uses 1 to 3 credits depending on the recipient's country, as per the scale published on the pricing page. An SMS refused by the provider is credited back. Purchased credits are not refundable, convertible or transferable to another organization, and are lost when the account is deleted. To prevent abuse, hourly and daily sending limits apply; beyond them, alerts continue through your other channels. OKStatus hands SMS to its provider but does not guarantee their delivery by the recipient's mobile operator.
Article 6 — Service availability
6.1 For paid plans, OKStatus commits to 99.9% monthly service availability. That commitment, the components it covers, the measurement method, the exclusions, the credit scale and the claim procedure are set out in the SLA Annex, which forms an integral part of these Terms. The Free plan is provided with no availability commitment.
6.2 Planned maintenance is announced at least 48 hours in advance on status.okstatus.eu and by email to the organisation's administrators.
6.3 Availability is measured by the OKStatus external monitoring system, hosted with an infrastructure provider distinct from the one hosting the service. Its measurements and the past 90 days of history are published openly on status.okstatus.eu.
6.4 OKStatus cannot be held liable for service interruptions caused by events beyond its control (force majeure, third-party network failures, etc.), under the conditions of article 5 of the SLA Annex.
Article 7 — Data and intellectual property
7.1 You retain full ownership of your data (monitor configurations, uptime data, reports).
7.2 You grant OKStatus a limited licence to process your data for the sole purpose of providing the service.
7.3 The OKStatus platform, its code, its interfaces and its documentation are protected by copyright and belong to ClearCloud. Any unauthorised reproduction is prohibited.
Article 8 — Liability
8.1 OKStatus is provided "as is". OKStatus does not warrant that the service will be error-free or that monitoring data will be exhaustive.
8.2 OKStatus cannot be held liable for indirect losses, loss of profit or consequential damage arising from unavailability of the service.
8.3 In any event, OKStatus's liability is limited to the amounts actually paid by the user over the last 3 months.
8.4 The credits provided for by the SLA Annex are the user's sole remedy in respect of service unavailability. They count towards the cap in article 8.3.
Article 9 — Termination and account deletion
9.1 You may delete your account at any time from your account settings. This action is irreversible and permanently deletes all your data.
9.2 OKStatus may terminate your access in the event of a breach of these Terms, with prior notice except in the case of a serious breach.
9.3 Discontinuation of the service. If ClearCloud decides to stop operating OKStatus, it notifies every organisation owner by email at least 90 days before the shutdown. During this notice period the service keeps running and the export of your data remains available from your account settings. Amounts paid in advance for any period after the shutdown are refunded pro rata. Data is deleted at the end of the notice period, then from backups within 30 days, as set out in the DPA.
Article 10 — Changes to the Terms
OKStatus reserves the right to amend these Terms. You will be informed by email 30 days before any substantial change takes effect. Continued use of the service after that date constitutes acceptance of the new terms.
Article 11 — Governing law
These Terms are governed by French law. Any dispute falls within the jurisdiction of the courts of Dijon, unless the law provides otherwise.
